Subscription Cancellation Shake-Up: FTC’s Click-to-Cancel Rule Blocked by Court

The FTC’s Click-to-Cancel rule was blocked by the court, but subscription and cancellation laws still matter. Learn what fitness businesses must do in 2025.

The FTC’s Click-to-Cancel rule just hit a significant roadblock. A federal appeals court—specifically the Court of Appeals for the Eighth Circuit—blocked the rule from taking effect, meaning businesses no longer need to offer online cancellation options for now. This decision “nullifies the rule unless and until a new, legally viable version is introduced.”

FTC May Reintroduce the Click-to-Cancel Rule

But this doesn’t mean the story is over. The Federal Trade Commission (FTC) could revise and reintroduce the click-to-cancel requirement. If this happens, businesses may need to re-implement online cancellation options. After all, the goal of the rule—making it easier for consumers to end recurring subscriptions and memberships—still aligns with growing regulatory and consumer pressure.

State Law Requirements Still Apply to Subscription Cancellations

And while the federal trade mandate is paused, state law requirements are very much alive. States like California and New York already enforce strict cancellation laws, including regulations surrounding the automatic renewal of subscriptions and subscription services tied to a free trial or negative option feature. More states are expected to follow, continuing the momentum toward easier cancellations.

Simplifying Cancellation Processes is Now a Best Practice

So what’s the takeaway for fitness businesses?

Even without a federal rule in place, the demand for clear and simple subscription cancellation processes is only increasing. The Health & Fitness Association advises clubs to proactively enhance their cancellation processes “that strike the right balance between member rights and operational feasibility for clubs and studios”—not only to stay compliant, but to boost member trust and satisfaction. It’s a smart move in today’s market, where deceptive practices related to subscriptions can lead to enforcement actions, legal exposure, or damage to your brand.
